Simple is best: "We had a good run for 15 years but now it's 6 months that we have been apart and I want to move on with my life. I wish you well in yours."

If she hasn't agreed to the March 21 hearing this is a note she should get beforehand. If she has, surely she knows what it's about and won't be surprised by a request for a formal divorce.

Thanks for your imput. I have to check with the attorney's office to see if she knows about it or not. Even if he hasn't been served, then I will proceed with it.

Charlie, you can't proceed with anything unless she has been properly notified / served. However, once properly notified, she cannot keep you from getting a divorce. In the end, if she does not show up, she forfeits and you get whatever you want. That's in Texas anyway.

Here is the update. She showed up to court (without an attorney), but with a woman that we both know and this woman that I have known for years is the type to want to "stick it to you" if you screw with me. Here is what the soon to be ex wants:

1) $1,000.00 per month for "maintenance".

2) Part of my 401K.

3) Wants me to put her back on my medical

plan at work.

What does she want? Me to pay all her living expenses? I think NOT!!!

Anyway, the judge told her that she had to file a financial statement and have an attorney by April 11th as the judge wants a conference call with the two lawyers on that date (after they have talked to each other)to discuss settlement. I think is she wants to play nasty, then I think I will have the monies she wants (I'll give her half)dropped into her lap all on once which will kill her disability payments and her medical or medicad assistance. I will NOT allow her to be put back on my medical plan unless I am ordered to do so by the courts. There is no way in Hell she is going to get all that she is asking for. I am just waiting for my attorney to contact me after he talks (or doesn't talk with her attorney).
